This website is owned and operated by JSK Tours & Travel Sdn Bhd (Company No. 1232740-M), whose registered office is at Lot 67, Shoplot 1B, Far East Garden, Jalan Lintas, 88300 Luyang, Kota Kinabalu, Sabah.

For the purposes of these Terms and Conditions, "We", "Our", "Company" and "Us" refers to JSK Tours & Travel Sdn Bhd while references to "You", "Your" and "Yourself" refers to the persons accessing this website (including persons who access this site on the behalf of other persons), references to "Material" or "Materials" includes data, information and databases.

Please review these Terms and Conditions carefully before using this website. Your use of this website indicates Your agreement to be bound by these Terms and Conditions in consideration of the access provided to the website as detailed below. All information on our website is subject to change without any prior notification, should the need arise.

If You are not agreeable to these Terms and Conditions, any of the related documentation linked below or other restrictions notified to You during the course of Your usage of this website then you should exit from this website and/or any other services or applications for online booking herein.

REPRESENTATION & WARRANTIES

By using the various services contained in our website, You hereby warrant that (i) You are of full age (18), (ii) You have the legal capacity and authority to enter into a legal binding contract, (iii) all information and/or Materials supplied by You herein shall be true, accurate, current and complete, and (iv) You agree to indemnify us from any loss, damage, cost, expense, liability and claims which may be suffered and/or incurred by us resulting from Your use of this website for any illegal or unauthorised purposes.

TERMS OF BOOKING

Any booking or submission of enquiry form(s) via our website and/or email conducted shall act as an acceptance of a contract between Yourself and the Company.

The payment methods and details contained in the booking or enquiry form(s) submitted by You shall be treated as You have duly authoritised us to act for and on behalf of the person(s) named on the booking requests for tours and travel services offered by us.

For instant booking, immediate confirmation will be issued in relation to Your reservation upon successful online payment transaction.

For non-instant booking, reservations made via our website may be held up to 2 or 3 days (unless otherwise stated) from the date of invoice issued to You. An initial deposit of 50% is required to secure the all other bookings and the balance must be paid at least 14 days prior to departure.

In case of any last minute reservation made within 14 days prior to the estimated departure date, a sum equivalent to 100% of the full payment is required to secure bookings and any admission to the tour.

It is advisable that You are to comply with our reservation and booking terms that stated in the pre-schedule time in the payment invoice such as airport transfer, hotel pick-up time, the safety manual and welcome kit in respect of all activities during the tours with the company.

TERMS OF PAYMENT

All prices on our website for the services offered are shown in Malaysian Ringgit ("RM"), unless otherwise stated. Prices may vary depending on the availability of the products and/or services and other unforeseen factors such as variation of prices by other service providers in associated with us.

Payment can be made via visa or master credit card in RM only. There will be no convenience fee applies for all the credit card transactions made through our website.

TERMS OF AMENDMENT AND CANCELLATION

Any amendment to bookings after payment is made will be charged at a minimum of RM30.00 per service amendment together with any charges as levied by the airlines, hotels, climb operators or other service providers involved.

A transfer to another package within the time of less than 30 days prior to departure does not constitute an amendment but would be treated as cancellation of the original booking and is subject to the fees provided in the Cancellation Policy below.

CANCELLATION POLICY

You are required notify us in writing for any cancellation of booking request and shall be subject to the following charges

3. 7 days or below 100% of tour cost

REFUNDS

There would be no refunds for cancellation once the tour has commenced or for any unused tour services including, but not limited to, transfer, meals & accommodation, sightseeing or any other services not utilized.

In any event and circumstances that there is a refund to You by us, the refund will be credited back to You in the payment advice manner. The processing time for such refund shall take up to 14 – 28 working days.

AIRPORT TRANSFERS

You are required ensure and to provide the arrival/departure flight details at the time of reservation for any airport transfer. Transfer arrangements will not take place in case of any insufficient or inaccurate information provided and there will be no refund for such unused services.

Our driver(s) or representative(s) will welcome and meet You in person at the airport arrival hall (unless otherwise arranged) with a placard bearing Your good name. You are advised to dial the relevant telephone number stated on the itinerary in case of any difficulties in locating our representative or the appointed meeting place. For all land transfers, our ground operator will make the arrangement in advance. Should You need to change the pickup time, please ensure the ground operator is informed at least 24 hours prior to Your departure. The change request is subject to seat availability.

SEAT–IN COACH TOURS

Tours are conducted and provided in air-conditioned tourist coach, minibus or van depending on group size, and seating arrangement will be allocated to adult and child (3 years & above) paid price, no seat allocated for infants below 3 years old.

We shall not be responsible or liable for any valuable or belongings left behind or lost in the vehicles. Pickup times from hotels are on time but it may be vary subject to the traffic conditions at the material time. Should there be any delay, please dial the relevant telephone number as stated on the invoice before making alternative arrangements. We reserves the right to alter routes, timetables, itineraries and accommodation reserved at short or no notice should conditions beyond our control render it necessary.

TRAVEL DOCUMENTS & VISA

All passports and visas must be valid for at least six (6) months from the date of entry into the country destination and You are fully responsible to ensure the same. We are not responsible or liable for any expenses, reimbursements or refund of any tour fare in the event of any refuse entry by immigration authorities into the country of destination for any reason whatsoever.

INSURANCE & HEALTH

All tour package offered by the Company are exclusive of Personal Accident Insurance and You are hereby advised and recommended to purchase a comprehensive personal travel insurance policy for the duration of the trip, where possible, to cover against Personal Accident, Loss of Baggage, Delays, Unexpected alterations to travel arrangements, Cancellation, Act of God, Emergency Medical Evacuation, Infectious diseases, Epidemics, Terrorism and etc. You must ensure that you are in good health condition in order to enjoy the tour. Where relevant, it is recommended that all climbers should have themselves medically checked before attempting any mountain climb. It is vital that climbers with pre-existing medical problems or conditions make these known to us as well as consulting their doctors for vaccination and other medical requirements before the trip.

LIABILITIES & RESPONSIBILITIES

We hereby disclaims any responsibility and liabilties for any loss, damage, accidents, sickness or changes in schedules caused by weather, strikes, force majeure or any other irregularity outside our control. You further agree that we shall not be held responsible for any agent, hotel, tour operator, guide, restaurant or any other person's acts, defaults or company's delays. We reserve the right to alter routes, itineraries or departure times, without prior notice, should the necessity arise. You are obligated to follow the directions of professionals, such as tour guides and car rentals, regarding safety and regulations.

PERSONAL DATA PROTECTION ACT 2010

We will regulate according to strict standards of client personal data and information by ACT 709, Personal Data Protection Act 2010 enacted by the Parliament of Malaysia. The Company will limit and use of your personal information to the minimum level and control over or authorizes the processing of client's personal data in respect of commercial transactions.

COMPLAINTS & COMMENTS

Any complaints or comments should be lodged in writing with supporting documentation to the company within 7 days from date of the tour.
